台灣佛寺爭訟事件之研究-以中華佛寺協會《佛寺季刊》案例為探討範圍=A Study on the Litigation of Buddhist Temples in Taiwan—Based on the Cases Mentioned in “Buddhist Temple Quarterly Magazine”
There are a great number of literatures related to religion legislation, but many only discuss general trends without refined attention to details such as actual causes of action. In this article, we take the actual law suits reported by Buddhist Temple Quarterly Magazine published by Chinese Buddhist Temple Association as major subject to find out the most common and wide spread topic for further case study and analysis in the hope of providing valuable reference for the future religion legislation. In this article, we adopted document analysis method to summarize the common topics according to causes of actions from all cases reported by Buddhist Temple Quarterly Magazine to date, which are presented in tables to clearly outline actual lawsuit situations. In addition, we then conducted comparison analysis and case-by-case analysis to further probe into means for solution and improvement. The four kinds of lawsuits summarized from Buddhist Temple Quarterly Magazine are: Ossuaire, Administration, Ownership and Management rights, which are presented according to respective proportion. The author selected the ownership lawsuits, as being the most influential, and the management lawsuits, as being the most commonly happened, for discussion and research.
