| Abstract | 我國對於土地使用分區編定，並無專為宗教編定用地，皆是經由取得土地後再依相關法令規定進行變更編定，而相關法令(建築、都市計畫、區域計畫及土地使用管制規則等)眾多，而非都市土地申請變更編定為特定目的事業用地作為宗教建築使用，涉及水土保持、環境影響評估及其他建築、地政等方面專業知識，有時耗時耗力卻達不到預期效益。而「國土計畫法」之施行，勢必影響宗教用地之取得。
希望籍由此研究促進宗教建築合法化之申請，改善違章問題，籍由文獻研究-相關法令之研究、農業用地之研究，探討農地變更之因素；了解非都市土地-農業用地變更作宗教用地之區位條件及因素。彙整相關雲林縣之案例，並以古坑鄉「慈光寺」為實證研究對象，探討農地變更作宗教用地之可行性因素。
In our country’s land use zoning, there is no dedicated land for religion. They are all changed and edited in accordance with relevant laws and regulations after acquiring the land. The relevant laws and regulations (construction, urban planning, regional planning, and land use control) There are many rules, etc.), but non-urban land applications are changed to be used as religious buildings for special purpose business land, which involves water and soil conservation, environmental impact assessment and other professional knowledge in construction, land administration, etc., sometimes time-consuming and labor-intensive. Expected benefits. The implementation of the "Law of Land Planning" will inevitably affect the acquisition of religious land.
It is hoped that this will study the application of promoting the legalization of religious buildings, and improve the problem of violations. Based on the literature research-relevant laws and regulations, agricultural land research, to explore the factors of agricultural land change; understand the non-urban land-agricultural land change as religious land Location conditions and factors. Collect relevant cases in Yunlin County, and use Gukeng Township as the research object to explore the feasibility of changing agricultural land as religious land. |
