Abstract 佛教律典保存豐富僧團史料與體現深刻理性思維,具有高度學術研究價值。唯因律文艱深而內容繁多,若非通過系統性規範架構與之對比,難以襯顯背後蘊含的法理意涵。本文以《四分律》「重殺戒」(殺人戒)為考察案例,參照今日刑法學「總則」、「分則」解析模式,首先檢視「重殺戒」主、客觀構成要件,除解消因原典艱深造成的閱讀障礙,並將原文系統化與概念化,作為法理討論的基礎。其次根據前述構成要件分析結果,藉由現代刑法學開出概念與論述面向,逐一探求重殺戒之法理與法律質性問題,包括:人之始期判斷標準為何?如何處理「認知障礙、錯誤」、「故意、過失」、「既遂、未遂」?是否成立「直接正犯、間接正犯」、「教唆犯、幫助犯」等問題。希望藉此研究確立跨領域學科合作的可能,更進一步豐富當代佛學研究向度與內涵。

The Buddhist scriptures are highly valuable for academic research since they contain abundant historical data of sangha and a profound reflection on rational thinking. However, explaining the jurisprudential implications of the difficult and considerable quantities without comparing them to systematic standard is not easy. This research analyzes "the precept against killing" in the harmagupta Vinaya using the modern criminal lavw model as "general principles" and "kinds of offenses". First, the mental and behavioral elements (means rea and actus rea) are inspected and then the difficulty of reading is resolved for later jurisprudential discussion by systematizing and conceptualizing the complex original. Then, this study searches for legal and jurisprudential questions within the precept, including defining the start of a human life; handling "cognitive impairment versus error "intention versus negligence and "completed offense versus attempt" establishing "direct/indirect perpetrator" and "abettor/aide, etc. The purpose of this study is to promote interdisciplinary cooperation and enrich the dimension and content of modern Buddhology.
