| Abstract | インド古典では広く，刑罰は王権の主要な機能であり，その創造の理由でもあるとされた．インド仏教においても同様である．だが死刑や身体をひどく損傷させる重度の身体刑は，不殺生の戒めとの関係が問題になる．本稿は，Kūṭadantasutta，Milindapañha，ナーガールジュナ作Ratnāvalī，Satyakaparivarta，チャンドラキールティ作Catuḥśatakaṭīkāを主題材に，インド仏教における刑罰観の一側面を明らかにする．
インド仏教の刑罰論は，不殺生に加え，刑罰の目的と効果，王と受刑者の業の状態，刑を執行する際の王と受刑者の心理状態をめぐる論点を含んでいる．上記文献が説く刑罰観を大きく3つに分類することができる．（1）王は死刑を含む刑罰を執行できる．死刑は受刑者自身の業の報いとして生じる．ここでは刑を執行する王の業の問題は議論されない．（2）王は死刑と重度の身体刑を除く刑を執行できる．死刑などの重刑は殺生に相当するため，王に悪業の問題が生じる．加えて，大乗文献には，刑罰は罪人の矯正を目的として憐れみをもって行うべきとする見解がある．それらの文献では，この観点からも死刑などの重刑が禁止されている．（3）刑の執行は，もし問題の解決に至らないのであれば，必須ではない． |
