| Abstract | 본 논문은 빨리율에 보이는 ‘비구니 바라이 불공계(不共戒)’의 제정 의도를 검토한 것이다. 비구니 바라이 불공계란 비구 구족계에는 없으며 비구니 구족계에만 있는 바라이 조문을 말한다. 바라이에 해당하는 행위는 일반적으로 음욕(婬欲)ㆍ5전 이상의 투도(偸盜)ㆍ살인(殺人)ㆍ대망어(大妄語)의 네 가지로 알려져 있지만, 이것은 비구ㆍ비구니에게 공통적으로 적용되는 ‘공계(共戒)’이다. 비구니는 이 넷에 마촉계(摩觸戒)ㆍ부비구니중죄계(覆比丘尼重罪戒)ㆍ수순피거비구위간계(隨順被挙比丘違諫戒)ㆍ팔사성중계(八事成重戒)의 넷을 추가하여 총 여덟 가지 행위를 바라이로 한다. 바라이는 바라제목차 조문 중에서도 극중죄(極重罪)로 분류되는 무거운 죄이다. 이러한 중죄가 비구보다 두 배나 많다는 사실은 중죄로 인한 신분 상실의 위험을 비구니가 배로 안고 있었음을 보여준다. 게다가 이들 네 계에서 금지하는 행동은 비구 구족계에서도 금지하지만, 비구계에서는 바라이가 아닌 그 보다 가벼운 승잔(僧殘)이나 바일제(波逸提)의 대상이다. 유사한 행동에 대해 다른 처벌을 적용하는 것이다. 비구에 비해 비구니의 바라이 항목이 두 배나 많고, 또한 유사한 행동에 대해 비구니와 비구 간에 다른 처벌이 적용된다는 점을 어떻게 이해해야 할까? 본고에서는 비구니 바라이 불공계의 인연담이나 조문의 내용, 나아가 비구계의 해당 계와의 비교 등을 통해 이들 불공계의 제정 의도를 파악해 보았다. 이에 근거하여 비구니에게 특별히 강조될 수밖에 없었던 행동 및 그 이유, 나아가 차별 여부 등에 대해서도 의견을 제시하였다.
This paper examines the intention in the enactment of pārājika(波羅夷) precepts particular to bhikkhunīs in the Vinayapiṭaka. The acts corresponding to pārājika are generally known as four kinds of sexual intercourse(婬欲), stealing(偸盜), taking human life(殺人), and lying about one’s spiritual achievements(大妄語). These precepts are common to both bhikkhu and bhikkhunī(共戒). On the other hand, bhikkhunīs have four more acts corresponding to pārājika precepts that consist of having physical contacts below the armpit and above the knee(摩觸戒), concealing a grave offense of another bhikkhunī(覆比丘尼重罪戒), following a bhikkhu suspended by the saṃgha(隨順被挙比丘違諫戒), and doing eight things(八事成重戒). Therefore, the bhikkhunīs’ acts corres- ponding to pārājika precepts are all eight acts. The acts specified in these four pārājika(波羅夷) precepts particular to bhikkhunīs are also prohibited in Bhikkhupātimokkha. However, Bhikkhupātimokkha is not treated as pārājika but as a lighter saṃghādisesa(僧殘) or pācittiya(波逸提). That is, discriminating punishments are imposed on the same behavior. In this paper, I will examine the contents of pārājika(波羅夷) precepts particular to bhikkhunīs and compare them with those of bhikkhupātimokkha, and try to grasp the intention in enacting these precepts.
