| Abstract | 諸部의 율장에서는 破僧 즉 승가의 분열(saṃghabheda)을 일차적으로 이설의 제시(唱說)와 승가를 구성하는 최소인원의 동의(取籌)라는 두 조건에 의해 일어나는 無間罪로 규정하지만, 제 부파 중 가장 보수적이라는 설일체유부의 아비달마에서는 불타입멸 이후에는 법륜의 파괴에 따른 승가분열(破法輪僧)은 일어나지 않았다고 말한다. 이에 따르는 한 그들의 부파분열(nikāyabheda)은 破法輪僧이 아닐뿐더러 갈마의 파괴에 따른 승가분열(破羯磨僧)도 아니라는 작업가설이 성립한다. 그렇다면 法․律 등에 대해 견해를 달리함으로써 비롯된 그들 제 부파의 성립근거는 무엇인가?본고에서는 부파의 분열과 개별승가로서의 출현이라는 현실사태가 ‘화합승가’라는 이념적 가치를 훼손하지 않았다는, 혹은 破和合僧의 무간죄가 아니라는 당시 불교도들의 사유에 대해 추구하였다. 결론적으로 言諍(vivādādhikaraṇa)으로 인해 승가에 분쟁이 일어나 現前比尼와 多人語의 滅諍法을 통해서도 종식되지 않을 경우, 양측은 如草覆地法을 통해 다툼 중에 야기된 불미스러운 언행을 서로 참회하고 자의에서든 타의(擧罪갈마)에서든 不同住가 되어 기존승가와는 界(sīmā)를 달리하여 별도의 포살/갈마를 행함으로써 새로운 현전승가로 출현하였다. 이는 동일 界 안에서 별도의 갈마를 행하는 破僧이나 4인 미만의 분쟁인 僧諍과는 구별되는 것이었다.
이에 당시 불교도들은 ‘현전승가로서의 화합’뿐만 아니라 각기 견해를 달리하는 ‘다양한 개별승가의 화합’을 추구하지 않으면 안 되었다. 그것은 젖과 물처럼 서로를 배척하지 않는 것이었다. 장아함 『淸淨經』에 의하면 그들은 12部經을 자신들이 作證한대로 유포(전승)할 수 있었다. 율장의 승가 운영방식을 통해 볼 때 부파분열은 일어나지 말았어야 할 사태가 아니라 “法性(眞實)에 어긋나지 않으면 불설”이라는 열린 성전관의 당연한 결과였다.
In the Vinayapiṭakas, primarily a split of saṃgha (saṃghabheda) are defined as a sin of Naraka which happens under the two condition; proposition of different view and consent of the minimum member of saṃgha.
However in the Vaibhāṣika Abhidharma which is the most conservative order, the split of saṃgha because of dharma destruction(cakrabheda) did not happen after the nirvana of Buddha. For this reason, the working hypothesis that, the schism of nikāyas(nikāyabheda) is neither a cakrabheda nor a split of saṃgha by karma destruction(karmabheda). Then what is the basis of schism of Buddhist sects(nikāyas) by having different point of view to the Dharma? This thesis pursued the thoughts of Buddhists who claimed that the schism of nikāyas and appearance of individual saṃgha as the real affair not only did not harmed the ideological value of the 'harmony of saṃgha', but also is not a sin of Naraka caused by saṃghabheda. To conclude, in case the dispute of doctrine(vivādādhikaraṇa) do not resolved(samathā) by the immediate judgement (sammukhāvinaya) or majority vote(yebhuyyasikā), both sides repent each other doing shameful things, such as abuse, slander, beating etc. which happened during the dispute(tiṇavatthāraka), after then, the new saṃgha could be established through uposatha karma, set-up a different boundary(sīmā) and in the different place. This is distinguishing comparing with the split of saṃgha (saṃghabheda) by going through separate uposatha karma in the same boundary, and the saṃgha dispute(saṃgharāji ) of less then 4 people.
Hence Buddhist had to pursue not only a harmony of a here and now existing(sammukhībhūta) saṃgha, but also a harmony of various individual saṃgha. According to Dīrghāgama No.29(淸淨經) they could transmit dvādaśaṅga (12部經) as the way they understood. Buddhist sects(nikāya) are inevitable consequences of opened view on scripture, so called as “It is Buddhist text if the word is not contrary to the truth(dharmatā).” |
