| Abstract | 본 논문은 율의 제정 이념인 ‘제계십리(制戒十利)’에 근거하여, 현재 추진되고 있는 대한불교조계종의 새로운 청규 제정의 방향성을 모색한 것이다. 최근 발생한 승풍 실추 사건으로 인해 승가의 위상이 대내외적으로 크게 추락했다. 이에 조계종단은 승가의 위상을 바로 잡고자 다양한 방면에서 노력을 기울이고 있으며, 그 일환으로 모든 조계종도가 공감하며 실천할 수 있는 ‘청규’ 제정을 위해 청규제정위원회를 구성, 본격적인 노력을 기울이고 있다. 현재 조계종의 승려들은 『사분율』과 『범망경』보살계, 청규, 종헌․종법이라고 하는, 때로는 서로 상치하기조차 하는 내용을 담고 있는 무시무시한 분량의 네 가지 규범집 사이에서 혼란을 겪고 있다. 새로운 청규는 이러한 혼란을 가라앉히고 구성원들에게 실질적인 행동 지침을 제시하게 될 것으로 기대된다. 따라서 새롭게 제정될 청규는 네 가지 규범집의 이념과 내용을 잘 조화시키면서도 구성원이 납득하는 현실성 있는 조항들로 구성되어야 한다. 필자는 기존의 네 가지 규범집 가운데 특히 ‘율장(律藏)’(『사분율』을 비롯한 6대 광율)에 나타나는 제계십리, 즉 붓다가 율을 제정한 열 가지 목적이야말로 이러한 요구를 가장 적절하게 충족시킬 수 있는 가르침이라고 생각한다. 따라서 본고에서는 율장에 나타나는 율 제정의 근본이념인 제계십리를 중심으로 새로운 청규 제정의 방향성에 대해 고찰하였다. 제2장에서는 제계십리의 기본적인 내용을 빨리율 및 그 주석을 통해 고찰하였다. 『사분율』이 아닌 빨리율을 고찰 대상으로 선택한 이유는 내용상 양자 간에 큰 차이가 없으며, 빨리율에는 『사만따빠사디까(Samantapāsādikā)』라는 상세한 주석서가 남아 있어 자구(字句) 이해가 쉽다는 장점이 있기 때문이다. 제3장에서는 제2장의 내용을 근거로 제계십리에 담긴 좀 더 구체적인 내용을 승가의 안락과 화합, 개인의 평안과 해탈, 일반사회와의 조화, 정법(正法)의 확립이라는 네 가지 측면에서 고찰하였다. 제4장에서는 이를 토대로 율의 근본이념에 입각한 청규 제정의 방향성을 제시하였다. 새로운 청규 편찬에는 모든 구성원의 합의점 도출, 범계 행위와 처벌 기준의 상관관계 명시, 포살과 자자에 관한 규정 제시, 일반사회의 가치관 고려라는 네 가지 사항이 꼭 반영되어야 한다는 결론이다.
The purpose of this paper is to explore a new direction of establishing the Pure Rule of Jogye Order based on the analysis of the ‘Ten Purposes of Establishing Vinaya(precept)’ that is the establishing principle of Vinaya. Recently the status of the Buddhist community(saṃgha) has widely fallen due to recent scandals involving some monks. Accordingly, the Jogye Order has tried to boost its reputation in many ways. One typical example of the effort is that the Jogye Order is now trying to enact a ‘Pure Rule’ applicable to all Buddhist members of the Jogye Order by establishing a Committee for the Enactment of Pure Rules. Presently the members of the Jogye Order are confused by the numerous collections of four standard rules, which sometimes contradict each other, i.e. Vinaya of the Four Categories(『四分律』), bodhisattva precepts of the Sūtra of Brahmā’s Net(『梵網經』), the Pure Rules(淸規), and the constitution and laws of the Order(宗憲․宗法). The new Pure Rule is expected to clear away the confusion raised until now and provide clear and comprehensive guide-lines for all members of the Jogye Order. So the new Pure Rules of the Jogye Order should be composed of realistic provisions that harmonize the four standards acceptable to all members of the Jogye Order. Personally I think that the ‘Ten Purposes of Establishing Vinaya’ which appeared in the Vinaya-piṭaka is the most satisfying teaching to reflect the purpose of the Buddhist precepts. Accordingly, this paper will explore the direction of establishing the new Pure Rule with a focus on the Ten Purposes of Establishing Vinaya. In chapter two, I examine the basic contents of the Ten Purposes of Establishing Vinaya through the Pāli Vinaya and its commentary. The reason why I chose to examine the Pāli Vinaya rather than the Vinaya of the Four Categories is that firstly, there is no big difference between the two and secondly, a detailed, easily understandable commentary text called Samantapāsādikā is still extant concerning the Pāli Vinaya. In chapter three, I examine the more specific contents of the Ten Purposes of Establishing Vinaya in terms of the peace and harmony in the Buddhist community, the individual peace and liberation, the harmony with society, and the establishment of the true Dharma(正法). In chapter four, I provide the direction of establishing a new Pure Rule on the basis of the fundamental principle of Vinaya examined in Chapter three.
