| 抄録 | 본 논문은 고(故) 김할머니 가족에 의한「무의미한 연명치료 장치의 제거 등 청구소송」으로 제기된 연명치료중단에 대한 사회적 논의를 불교적인 입장에서 살펴본 것이다. 대법원은 환자의 상태를 회복불가능한 상태로 보고 연명치료를 중단하고자 하는 추정의사를 인정하여 이를 허용하였다. 이에 따라 대한의학회·대한의사협회·병원협회는 「연명치료 중지에 관한 지침」을, 국회에서는 신상진 의원이 대표발의한 「존엄사법안」과 김세연 의원이 대표발의한「삶의 마지막 단계에서 자연스러운 죽음을 맞이할 권리에 관한 법률안」이 상정되어 논의되고 있다. 보건복지부에서도 사회단체, 법조계, 의료계, 종교계의 대표들로 구성된 연명치료중단 제도화 관련 사회적 논의 추진 협의체를 2009년 12월에 구성하여 7개월간의 운영 결과를 2010년 7월에 보고하였다.
따라서 이러한 논의의 핵심은 죽음의 자기결정권에 대하여 제안된 안을 중심으로 법률적인 문제와 불교의 입장에서 이러한 문제에 어떻게 대응할 것인가에 대한 검토이다. 기본적으로 자기결정권은 헌법에 제시된 개인의 인격권과 행복추구권에 바탕하고 있다. 불교계에서는 아직 구체적인 대응장치를 마련하고 있지는 않지만 연기론(緣起論)의 교설과 대승정신은 연명치료중단의 자기결정권에 대해 폭넓은 해석을 제공하고 있음을 알 수 있다. 또한 생로병사라고 하는 인간의 한계를 극복하고자 한 불타의 깨달음에 의해 이루어진 불교의 죽음에 대한 수용의 자세는 자기결정권의 대리인 문제에 있어서도 열린 입장의 해석이 가능함을 알아보았다. 더욱이 사전의료의향서 등을 통해 사전(死前)에 자신의 죽음의 방식에 대한 의사를 개진한다고 하는 면에서 불교의 생사관이 사회적으로 큰 의미를 제공하고 있음을 알 수 있다. 이러한 점에서 본 논문이 연명치료중단의 법률제정의 동향과 더불어 불교계에서도 활발한 논의가 일어나는 하나의 계기가 되었으면 한다.
This paper is a study from the viewpoint of Buddhism on a civil suit brought against withdrawing life-sustaining treatments by Kim`s family. The supreme court confirmed the original verdict that recognizes the patient’s mind to be assumed because of her unconsciousness to withdraw life- sustaining treatments on May 21, 2009.
For this reason, Korean Academy of Medical Science, Korean Medical Association, and Korean Hospital Association prepared「a Guideline for Withdrawing Life-Sustaining Treatments」. Also Shin, Sang Jin as a representative proposed「a Law of the Death with Dignity」, and Kim, Se Yeon as a congressman proposed「a Law on the Right to Accept Natural Death in the Last Phase of Living」in the National Assembly. Ministry of Health and Welfare organized a social consultative group including representatives of social organizations, legal, medical and religious circles for the institutionalization of withdrawing life-sustaining treatments in December, 2009, and submitted productive results in July, 2010.
This paper is considering how society of Buddhism copes with this problem including legal problem on the decision-making rights of death. The decision- making rights is based on personal rights and the right to pursue one’s happiness which are stated in the Article 10 of the Constitution of the Rep. of Korea.
The teachings of cause and occasion in Buddhism and spirits of the Mahayana Buddhism provide diverse interpretation about the decision-making rights to withdraw life-sustaining treatments, although society of Buddhism is not yet arranging concrete alternatives. Buddhism which is wanted to overcome the limitations of human being, -birth, old age, sickness, and death- teaches embracement of death. The Buddhist teaching stands for the supportive side of the letter of intent before death -to clear one’s method to die by expressing their opinion through living will- which is still debated in the society. Furthermore this makes us open mind to the legal representative system in the decision-making rights of death.
It is hoped that this article may trigger a discussion over movement for legislation on withdrawing life-sustaining treatments in the society of Buddhism.
