不同於「刑罰式正義」,於1970年代開始興起的「修復式正義」(Restorative Justice,又稱「修復式司法」)旨在將過去司法以審判懲戒為中心的償還、應報式正義,轉往對犯罪發生過程中,對加害者、被害者及社會所造成的創傷之柔性「修復」,使破裂的關係得以在倫理實踐中被重建與療癒。 本論文旨在探究以心為本的「佛教懺悔觀」對於「業」、「因果」、「懺悔」等概念,與以人為本的「修復式正義」的相互關係,寬恕與理解如何應用於實際案例的方法與可能性。 論文研究內容:第一章闡述研究者的研究動機及目的,在舊有的法律規則與制度下,能否有寬恕錯誤行為的機會。第二章說明修復式正義的源起、發展脈絡,將司法轉向倫理的目的及價值。第三章以佛教經典為依據,探究經典中敘述懺悔種種影響的重要性。第四章探討佛教的懺悔觀與修復式正義之間的關聯性、相似性及差異性,並以訪談修復式正義實務工作者「修復式正義促進者」做為資料蒐集的對象,以實際案例狀況進行資料整合及成果分析。第五章結論將分析佛教的懺悔觀於修復式正義案件的的突破與限制、存在意義與倫理實踐,進而達到對降低犯罪者再犯的可能性,以及實踐的結論與建議。 Different from "penal justice", "Restorative Justice" (also known as "Restorative Justice"), which began to rise in 1970s, aims to transfer the repayment and retribution justice centered on trial and punishment in the past to the flexible "repair" of the trauma caused by the injurer, victim and society in the process of crime, so that the broken relationship can be rebuilt and healed in ethical practice. The purpose of this thesis is to explore the relationship between the concepts of "karma", "cause and effect" and "confession" in Buddhism's mind-based "confession view" and the people-oriented "repair justice", and the methods and possibilities of how forgiveness and understanding are applied to practical cases. The first chapter elaborates the research motivation and purpose of the researcher, and whether there is a chance to forgive wrong behavior under the old legal rules and systems. The second chapter explains the origin and development of Restorative Justice, and the purpose and value of turning justice into ethics. The third chapter, based on Buddhist classics, explores the importance of describing the influences of confession in classics. The fourth chapter discusses the relationship, similarities and differences between Buddhist confession and restorative justice, and interviews with restorative justice practitioners "restorative justice promoters" as the object of data collection, and carries out data integration and results analysis based on actual case conditions. The fifth chapter, the conclusion, will analyze the breakthrough and limitation of Buddhist confession view in repentant justice cases, its existence significance and ethical practice, so as to reduce the possibility of recidivism of offenders, as well as practical conclusions and suggestions.
